Terms of Service

These Terms of Service ("Terms") govern your use of the LikklePay platform, including our mobile application and related services. By creating an account, you agree to these Terms in full.

LikklePay is currently in beta. The platform is provided as-is during this phase. Features may change and we may contact you with updates. Your feedback helps us improve.

1. About LikklePay

LikklePay is a payment facilitation platform that allows registered merchants to accept card payments from their customers via QR codes and payment links. We use Stripe Connect to process payments and handle identity verification.

You must create an account with a valid email address and complete our onboarding process, which includes identity and business verification through Stripe. You are responsible for keeping your login credentials secure. Notify us immediately if you suspect unauthorised access to your account.

LikklePay and Stripe reserve the right to refuse or suspend accounts that do not meet verification requirements or that present an unacceptable risk.

4. Payment processing

Payment processing is provided by Stripe Payments Europe Ltd, licensed as a payment institution by the Central Bank of Ireland (licence number: C187865). LikklePay is a software platform and is not itself a payment institution — we do not hold, move, or process funds. By using LikklePay, you also agree to Stripe's Connected Account Agreement.

You may not use LikklePay to process payments for:

Violation of these restrictions will result in immediate account termination and may be reported to relevant authorities.

6. Refunds & disputes

As a merchant, you are responsible for your own refund policy towards your customers. LikklePay provides tooling to issue refunds through the app. Stripe's chargeback and dispute processes apply in the event of customer disputes. You are liable for any chargebacks, fees, or penalties resulting from disputes on your transactions.

7. Availability & beta limitations

LikklePay is provided during a beta phase. We do not guarantee 100% uptime or uninterrupted service. We may add, remove, or change features at any time. We will make reasonable efforts to notify you of significant changes.

To the maximum extent permitted by law, LikklePay is not liable for:

Our total liability to you shall not exceed the fees you paid to LikklePay in the 3 months preceding the claim.

9. Termination

You may close your account at any time by contacting us at hello@likklepay.com. We may suspend or terminate your account if you breach these Terms, fail KYC requirements, or engage in prohibited activity. Upon termination, any pending payouts will be handled by Stripe per their standard procedures.

10. Governing law

These Terms are governed by Belgian law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Belgium.

11. Changes to these Terms

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the platform after changes constitutes acceptance of the updated Terms.

12. Data Processing Agreement (GDPR Article 28)

This section constitutes a Data Processing Agreement ("DPA") between you (the merchant, acting as data controller) and LikklePay (acting as data processor) in accordance with Article 28 of the GDPR.

12.1 Subject matter and purpose
LikklePay processes personal data on your behalf solely for the purpose of providing the payment facilitation service described in these Terms. This includes processing your customers' payment-related data (such as email addresses submitted for receipts) as part of the transaction flow.

12.2 Nature of processing
LikklePay processes personal data by storing transaction records, sending customer receipts, and facilitating payment flows. Processing takes place exclusively within the European Economic Area (EEA) or with sub-processors that provide adequate data protection guarantees.

12.3 Your obligations as data controller
You are responsible for ensuring that you have a lawful basis to collect and share your customers' personal data with LikklePay, and that you have informed your customers about how their data is used in accordance with applicable data protection law.

We will notify you of any intended changes to sub-processors with reasonable notice, giving you the opportunity to object.

12.6 Data retention
Transaction records are retained for a minimum of 5 years in compliance with the EU Anti-Money Laundering Directive (AMLD5) and Belgian accounting law. Personal data not subject to legal retention obligations is deleted within 30 days of account closure.

12.7 Data subject requests
If your customers contact you exercising their GDPR rights (access, erasure, portability, etc.), contact us at hello@likklepay.com and we will assist you in fulfilling those requests within the legally required timeframe.
